Regarding Alameda County, this is the response I got from Supervisor Scott Haggerty's office on 1/15/13:

Supervisor Haggerty received and read your message regarding the plastic bag ordinance, and asked me to send a brief response. One of the misconceptions about this ordinance is that the Board of Supervisors is the governing body that took action to ban plastic bags. In fact, the ordinance came from the Alameda County Waste Management Authority, not the Board of Supervisors. Each city in Alameda County has an elected representative who sits on the Waste Management Authority Board. Below is a list of all elected members who make up the Waste Management Authority.

Also, with regards to Macy’s or Banana Republic, from what I’ve read these stores shouldn’t be impacted by the plastic bag ordinance.

“All grocery stores, mini-marts, convenience stores, liquor stores, other stores, and pharmacies selling packaged foods and/or alcohol in Alameda County are affected by the Reusable Bag Ordinance.

Businesses not affected include retail stores not selling packaged food, and public eating establishments including restaurants, coffee shops and bakeries. A public eating establishment is a business that receives 90 percent or more of its revenue from the sale of food prepared on the premises.”

Based on the number of calls this office has received I understand there is some frustration regarding this ordinance. I also believe there is some confusion and misinformation regarding the ordinance and the Waste Management Authority needs to do a better job of educating business owners and their employees about affected versus non-affected businesses.
